2. Description of Service

BillOfSaleKit provides an online platform for creating bill of sale documents. The Service allows users to input transaction details, generate professionally formatted PDF documents, and download those documents after payment. The Service is designed for use by individuals and businesses conducting private-party sales of personal property including vehicles, boats, motorcycles, trailers, recreational vehicles, equipment, and general personal property.

3. Digital Goods and Delivery

The documents produced by the Service are digital goods. Upon successful payment, you will receive immediate access to download your completed document in PDF format. A backup download link will also be sent to the email address you provide during checkout. Download links remain active for seven (7) days from the date of purchase. If you need access to your document after this period, contact our support team for assistance.

4. Pricing and Payment

The current pricing for documents is displayed on our Pricing page. All prices are in United States Dollars (USD). We reserve the right to change prices at any time, but price changes will not affect documents that have already been purchased. Payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service. You represent and warrant that you have the legal right to use any payment method you provide.

5. Refunds

Due to the nature of digital goods, refunds are generally not available once a document has been successfully delivered. However, we offer refunds in cases of technical failure that prevents you from accessing your purchased document within 30 days of purchase. 6. User Responsibilities

You are solely responsible for the accuracy and completeness of all information you enter into the Service. BillOfSaleKit does not verify the identity of users, the accuracy of transaction details, or the legality of any particular sale. You agree to use the Service only for lawful purposes and in compliance with all applicable federal, state, and local laws. You may not use the Service to create documents for fraudulent transactions, misrepresent ownership of property, or for any other illegal purpose.

7. Document Templates and Legal Advice

BillOfSaleKit is not a law firm and does not provide legal advice, legal opinions, or legal representation. The documents generated by the Service are templates based on commonly required fields and disclosures for each state. While we strive to keep our templates current with state requirements, laws and regulations change frequently. You are responsible for verifying that any document meets your specific state, county, and local requirements. We strongly recommend consulting with a licensed attorney if you have questions about the legal sufficiency of any document.

8. Intellectual Property

All content on the Service, including but not limited to text, graphics, logos, icons, software, and document templates, is the property of BillOfSaleKit and is protected by applicable intellectual property laws. Upon purchase of a document, you are granted a limited, non-exclusive, non-transferable license to use that document for its intended purpose (recording the transfer of property). You may not resell, redistribute, or commercially exploit the document templates or any other content from the Service.

9. Limitation of Liability

To the fullest extent permitted by applicable law, BillOfSaleKit and its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any errors, inaccuracies, or omissions in the documents generated by the Service; (c) any unauthorized access to or use of our servers and/or any personal information stored therein; or (d) any interruption or cessation of transmission to or from the Service. In no event shall our aggregate liability exceed the amount you paid for the specific document at issue.

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. BillOfSaleKit does not warrant that the Service will be uninterrupted, error-free, or secure, or that the documents will meet any specific legal requirements or be accepted by any government agency.

11. Indemnification

You agree to indemnify, defend, and hold harmless BillOfSaleKit, its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another party.
